Former Vice President Mike Pence will not appeal a judge’s order forcing him to testify in the Justice Department’s investigation into efforts to overturn the results of the 2020 election, a spokesman said Wednesday.
The decision paves the way for a possible appearance by Pence before a federal grand jury in the coming weeks.
Pence was subpoenaed months ago by the special counsel investigating efforts by former President Trump and his allies to overturn the election results before the January 6, 2021, riot at the Capitol.

Trump lawyers objected to the subpoena on the grounds of executive privilege, but last week a federal judge in Washington rejected those arguments and ordered Pence to testify. U.S. District Court Judge James Boasberg did give Pence a victory by accepting arguments from Pence’s lawyers that he could not be questioned about his actions on January 6 for constitutional reasons.
