Even the Supreme Court judge sued for double MTV
Even the additional government judges who impose the Motor Vehicle Tax (MTV), who imposed the same tax on the nation for the second time, revolted. Retired Supreme Judge of the State Council Tacettin Şimşek filed a lawsuit with Ankara’s first tax court, stating that buying MTV from the public for the second time is against articles 2, 10, 11 and 73 of the Constitution. Şimşek demanded that the tax court submit an urgent request to the Constitutional Court for the annulment of the law, and demanded that the costs of the lawsuit be collected from the Ministry of Finance, which requested the tax. Gündoğan stated that they also presented to the court the decision of the Constitutional Court of 23.07.2003 that canceled a similar additional regulation of MTV for unconstitutionality, and said: “We have also heard that the Constitutional Court will meet on September 6 due to “Pressure and decide on the additional issue of MTV”. The deadline to appeal and file a lawsuit against the additional regulation of MTV issued by the government to collect approximately 40 billion lira in additional taxes ends on Thursday, September 7. SÖZCÜ had previously announced that if the Constitutional Court decides to cancel, the additional MTV payments can only be refunded if a lawsuit is filed before September 7, and that those who do not file a lawsuit will not be refunded.CHP asked the Constitutional Court to cancel the additional MTV and suspend of execution.
RIGHT OF REIMBURSEMENT TO CLAIM
In the event that the Constitutional Court decides to cancel and suspend the execution until September 7, the additional MTV will be completely abolished and those who paid will be able to recover their money. However, only those who sued will have the right to return. If, following a possible annulment decision, the government enacts a new law and gives everyone a chance to return, extradition will cover everyone.
Contrary to the principle of “fair tax”
Retired judge Şimşek’s lawyer, Ali Erdem Gündoğan, gave information about the lawsuit they filed for the annulment of additional MTV, saying, “In addition, MTV adheres to the principle of guaranteed social status in Article 2 of the Constitution, and to the principle of equality and justice guaranteed in article 10. We file a lawsuit and demand that the court appeal to the Constitutional Court because it clearly violates the principle of fair and balanced distribution of the tax burden, which is guaranteed in article 11, which regulates that laws They cannot be unconstitutional, and the principle of taxation of all in proportion to their financial power.
