New requirements for real estate and automobile listings on the Internet
Inflation and rising currencies increased the prices of real estate and vehicles. The government, which wants to control the market, has imposed notable conditions on advertisements for the sale of second-hand vehicles and real estate.
The regulations published in the Official Gazette are the following:
“REGULATION TO MODIFY THE REGULATION ON THE TRADE OF SECOND-HAND MOTOR VEHICLES
ARTICLE 1- Subsection f) of the first paragraph of article 4 of the Regulation on the Trade in Second-Hand Motor Vehicles published in the Official Gazette dated 2/13/2018 and numbered 30331 is hereby repealed.
ARTICLE 2- The first sentence of the fourth paragraph of article 13 of the same Regulation and subparagraph c) of the same paragraph are amended as follows, the following subparagraph is added to the same paragraph to go after subparagraph (c), and the other subparagraphs are have been completed accordingly and the existing subparagraph (e) of the same paragraph has been amended as follows: has been amended as follows.
Individuals or legal entities that provide an electronic environment for advertising the sale of second-hand land motor vehicles, belonging to others, will be required to comply with the following:
c) Name, surnames and TR identity number or foreigner identity number and telephone number of the real person; Verify the title and telephone number of the legal entity before the membership or publication of the advertisement. Maintain and keep verified information updated.”
ç) Verify before publishing the ad that the vehicle object of the ad belongs to the partner who posted the ad or, if this member is a real person, to first and second degree relatives or to the spouse, or that the member who posted the ad is authorized by the owner of the vehicle object of the advertisement.
f) Take measures to avoid advertising that distorts the market structure or misleads the consumer, to comply with the measures adopted by the Ministry for the protection of the conditions of effective and sustainable competition and of the consumer.
ARTICLE 3- The fifth paragraph of article 23 of the same Regulation is amended, remaining as follows.
(5) Those who violate the fourth paragraph of article 13 of these Regulations will be subject to the administrative fines provided for in article 18 of Law No. 6585 in subsection d) of the first paragraph of article 12 of Law No. 6563 by the Ministry.
ARTICLE 4- This Regulation; a) Article 2 enters into force two months after its publication, b) The other articles enter into force on the date of publication.
ARTICLE 5- The provisions of this Regulation are executed by the Minister of Commerce.
REGULATION OF MODIFICATION OF THE REGULATION ON REAL ESTATE TRADE
ARTICLE 1- Following the phrase “subsection b) of the first paragraph” of the first paragraph of article 3 of the Real Estate Trade Regulations published in the Official Gazette on 05/6/2018 and numbered 30442, “, dated 10/23 /2014 and 6563 The first paragraph of article 11 of the Electronic Commerce Regulation Law No.
ARTICLE 2- Subsection g) of the first paragraph of article 4 of the same Regulation is hereby repealed.
ARTICLE 3- The first sentence of the second paragraph of article 12 of the same Regulations and subsection c) of the same paragraph are amended as follows, the following subsection is added to the same paragraph to go after subsection (c), and the other subsections are have been completed accordingly, and the existing subparagraph e) of the same paragraph has been amended as follows: is amended as follows.
Real or legal persons who provide an electronic environment for the sale of third-party real estate are required to comply with the following:
“c) The name, surnames and TR identity number of the real person or foreigner identity number and telephone number; Verify the title and phone number of the legal entity prior to membership or advertisement posting. Maintain and keep verified information up-to-date.”
“ç) Verify before publishing the announcement that the property object of the announcement belongs to the member who published the announcement, or if this member is a real person, first and second degree relatives or spouse, or that the member who published the announcement is authorized by the owner of the property object of the announcement.”
“f) Adopt measures to prevent advertising that distorts the structure of the market or misleads the consumer, to comply with the measures adopted by the Ministry for the protection of the conditions of effective and sustainable competition and of the consumer.”
ARTICLE 4- The fourth paragraph of article 22 of the same Regulation is amended as follows, and the phrase “6585” is added to the sixth paragraph of the same article, after the phrase “in application”.
“(4) The administrative fines provided for in article 18 of Law No. 6585 will be applied by the Ministry to those who violate the second paragraph of article 12 of this Regulation in subsection d) of the first paragraph of article 12 of Law No. 6585. 6563.”
ARTICLE 5- This Regulation; a) Article 3 enters into force two months after its publication, b) The other articles enter into force on the date of publication.
ARTICLE 6- The provisions of this Regulation will be executed by the Minister of Commerce.”
