Warning of critical lawsuit to Double MTV
A critical case warning came with the additional tax on motor vehicles (MTV), which the AKP government imposed on citizens to find resources. Ek applied to the CHP Constitutional Court (AYM) for the suspension and cancellation of MTV. If AYM cancels the extra MTV like in 2003, the tax will go away. However, the reimbursement will not be made to all vehicle owners, but only to those who have filed a claim within the legal term. Therefore, millions of citizens will keep what they paid for MTV. The deadline for submission is September 7.
DEADLINE SEPTEMBER 7
Assessing the regulation, which places an additional burden on more than 25 million vehicle owners, one of the Ankara Bar Association’s lawyers, Ali Erdem GündoÄŸan, warned citizens about critical details in tax cases. GündoÄŸan pointed out that tax refund cases are different from other areas and stated that the period to file a lawsuit against MTV additional is limited to 1 month, and that the period that came into effect on July 15 and should have ended on July 15. August was automatically extended. until September 7 for a judicial holiday.
Gündoğan pointed out that if the Constitutional Court cancels the additional MTV in the future, the refund will be made only to those who have filed a lawsuit by September 7, and those who have made the payment but have not filed a lawsuit. will not be refunded does not entitle. Tax refunds are also made only to those who file lawsuits, as established by law.
Gündoğan said that the Constitutional Court found a similar additional MTV law unconstitutional and annulled it in 2003, and that the new law is likely to be annulled today for the same reasons.
Fixed issue if execution stops
Lawyer Ali Erdem GündoÄŸan stated that it would be more appropriate for the Constitutional Court to suspend the execution of the law because it would cause irreparable results, saying: “If the execution is stopped, the loss of rights and the extradition confusion of millions of citizens will disappear.” GündoÄŸan said that in the event of a possible annulment decision in the future, complaints will be avoided if a new law is passed stating that everyone will be reimbursed without the condition of filing a claim with the Grand National Assembly of Turkey.
