State Council E-Commerce Decision
The Tenth Chamber of the State Council resolved to suspend the execution of the “Regulations on Electronic Commerce Tool Service Providers and Electronic Commerce Service Providers” issued for the implementation of the Electronic Commerce Law No. 6563, which caused serious discussions in the sector .
Said regulation was prepared by substantially modifying the Electronic Commerce Law No. 6563 with Law No. 7416 published in the Official Gazette on July 7 of last year.
Until the Council of State rules on this issue again with its decision, the execution of some articles has been suspended.
IN THE CONSTITUTIONAL COURT
Execution was also suspended on article 19 of the regulation, which establishes that platforms cannot sell products with their own brands in their own markets, and that access cannot be granted between these pages if they are sold on different pages.
In addition to the Council of State, a lawsuit was filed before the Constitutional Court for the annulment of the Electronic Commerce Law as unconstitutional.
