The “Skilled Immigration Law”, enacted by the German government to increase the number of qualified personnel in the country and eliminate personnel shortages in some areas, came into effect from November 1. Part of the law will begin to be implemented in March 2024 and the other part in June 2024.

In accordance with the provisions that came into force from November 1, the salary limit for finding work in Germany and obtaining the Blue Card has been reduced. Those who find a job with a gross annual salary of 39,682 euros will immediately receive a Blue Card.

In addition, the professional groups for qualified personnel arriving in Germany were also expanded. In addition to personnel trained in fields such as mathematics, natural sciences, engineering and medicine, several professional groups will be able to come with a Blue Card when they find work.

A person who works in Germany with a blue card for 12 months will be able to obtain a residence permit. A person who works with a Blue Card for 90 days in EU member countries will be able to come to Germany and obtain an independent residence permit after 12 months of work.

Those who come with a tourist visa will be able to apply for a job. If you are accepted for the job and sign a contract, you will be able to stay in the country on a work visa.

WHAT WILL CHANGE IN MARCH 2024?

The situation for qualified personnel will further improve after March 2024. If all conditions are met, you will soon be entitled to a residence permit in the country. Occupational restrictions in workplaces will be eliminated and anyone will be able to work in any position they want. Language requirements will be relaxed.

Most importantly, drivers of trucks or other types of construction equipment from outside the EU will receive a simple visa. You will be able to do this work in Germany. The exams required for these will be eliminated and there will be no language tests.

During the trial period, the weekly working hours of all experts will be up to 20. There will be no need to worry about the equivalence declaration. In addition to the employment contract, at least two years of study or a university degree will be sufficient. It will be enough for the bride to be recognized by the country.

For many professional groups, for example, a “certificate of recognition” from the German Chamber of Commerce will suffice. Residence permits will first be issued for one year. It will then be extended for up to three years. Afterwards, unlimited sessions will be available. Proof of German knowledge will be required for permanent residence.

No professional or university degree will be required for computer science specialists. There will be no language requirement, but they must prove their knowledge. There will be special orientation courses or conferences for nurses. Nurses must demonstrate their expertise in this field.

STUDENT EMPLOYMENT AND INTERNSHIP

The possibilities of participation in the labor market for Turkish students who come to Germany to study will be expanded. The maximum working day, which was previously 120 full days or 240 half days per year, now becomes 140 full days or 280 half days.

The student will be able to work 20 hours per week in the workplace. There will be no upper limit on the salary amount. Scholarship opportunities will be provided. The possibilities of staying at German universities will be increased. The age limit for students applying for university and vocational training places was 25 years. There will be 35 and the language requirement will also be relaxed.

WHAT WILL CHANGE IN JUNE 2024?

After this date the Chance Card system will come into effect. The US, Canada and Australia model will be started. A university degree, a professional diploma or a specialization certificate will be more easily recognized in the corresponding State.

It will be enough to prepare it in advance in Türkiye. A recognition system will be applied, not an equivalence system. At least 6 points out of 10 will be sufficient in criteria such as connection with Germany, knowledge of the language, experience and age.

The employer will cover the necessary travel expenses; those who come will have an employment contract, the right to retirement and union membership. Those from Western Balkan countries will adapt more easily and comfortably to the labor market.
