Suspended ‘real estate law’ in Bosnia and Herzegovina

In the statement made by the Office of the High Representative of Bosnia and Herzegovina (OHR), Schmidt, after the Peace Implementation Council (PIC) meeting, using the powers of Bonn, decided that the Constitutional Court of Bosnia and Herzegovina ruled that real estate belongs to the state, not entities, in the National Assembly of the Republika Srpska at the entity level (NSRS) it is stated that it has suspended the voted law.

In the statement, it was reiterated that Schmidt suspended the law until the final decision of the Constitutional Court, in order to protect state property.

PROPERTY PROBLEM

Arguing that the real estate belongs to the entities under the Dayton Peace Treaty, which ended the war in Bosnia and Herzegovina in 1992-1995, RS argues that the administration of the assets is also theirs under said law.

While the unconstitutional law on real estate voted in the NSRS in December is expected to enter into force tomorrow, the public institutions used by the RS under the law are said to be “part” of them.

Although the problem of real estate has been a topic that has been talked about since the war in Bosnia and Herzegovina, it is debated whether the real estate in the country belongs to the state or to the user entities of this real estate.

Meanwhile, Denis Becirovic, a Bosnian member of the Presidential Council of Bosnia and Herzegovina, has asked the Constitutional Court to assess whether the law in question is in conformity with the constitution. (AA)
