House Speaker Mike Johnson indicated Thursday that he will send the articles of impeachment against Homeland Security Secretary Alejandro Mayorkas to the Senate shortly after Congress returns to Washington next month.

Johnson, a Republican from Louisiana, said he would send the two on April 10. Senate Minority Leader Charles E. Schumer (D-N.Y.) plans to swear in senators as jurors in the trial the next day, according to articles provided to his office .

The House of Representatives impeached Mayorkas in February on a razor-thin party vote, but Johnson had delayed sending the articles of impeachment to the Senate while Congress dealt with funding the government.

The impeachment proceedings against Mayorkas, who would be the first Cabinet secretary in nearly 150 years to receive this punishment, are expected to die quickly in the Democratic-controlled Senate.

Republicans took action against Mayorkas to rebuke his handling of the country’s southern border, but critics, including some Republicans, say the House of Representatives has not shown that the Cabinet secretary’s actions crossed the line of serious crimes and violations of the Constitution .

House Republicans failed to provide any evidence of anything resembling a criminal offense, Schumer said after the House acted.

But Johnson argued in a statement that Mayorkas has betrayed the public trust and willingly refused to follow federal immigration laws.

He deserves to be impeached and the American people demand that those responsible for the border crisis be held accountable, Johnson said.

Still, some Republican senators have expressed skepticism about the House of Representatives’ argument, and a conviction is highly unlikely.

Two-thirds of the Senate would have to vote to convict, as opposed to the simple majority needed to impeach in the House. That means all Republicans and a substantial number of Democrats would have to vote to convict Mayorkas.

However, a comprehensive process would allow Republicans to continue hammering the Biden administration’s immigration policies. Johnson urged Schumer to hold a full public trial to show he was committed to ending the devastation caused by Biden’s border catastrophe.
