Between the Turkish Coal Company and the General Union of Mining Workers; After the Amasra mine disaster, the first collective bargaining agreement was signed.

According to contract; Workers will be searched when entering and leaving the mine. According to the terms of the contract; Workers will avoid actions that provoke or offend workers against the employer, will not play games, and even if they die, their personal protective equipment, which is registered as an asset, will be returned to the employer, otherwise the cost will be charged. .

After the firedamp explosion in the Amasra mine, which caused the death of 43 miners; The details of the thirtieth collective bargaining agreement signed between the Turkish Coal Company (TTK) and the General Union of Mining Workers drew attention.

The provisions of the collective agreement also apply to workers working in the Amasra quarry, where the disaster occurred a year ago, as well as workers in Armutçuk, Karadon, Kozlu and Üzülmez.

“THE EMPLOYER MAY HAVE HIS PEOPLE AND BELONGINGS REGISTERED”

The responsibilities assigned to workers in the contract also attracted attention. According to this; Under the heading “Search”, it was stated that mining workers would be searched as they entered and exited the mine.

In the contract; “To prevent the commission of acts prohibited by law and guarantee the safety of the workplace and as a precautionary measure, the employer may have the persons and belongings of those entering and leaving the workplace and the mine registered through of the staff he will appoint. The employer may also order searches at workplaces, guest houses and common rest areas. However, the owner of the searched place and the union representative must be present in these records, and if the worker is not present, the union representative must be present.” Statements were included.

‘WILL NOT OFFEND THE EMPLOYER’

Under the title of “Requirements that Workers Must Meet”, the following responsibilities were assigned to workers:

“* Avoid using the workers and apprentices who work for him in his personal services… Avoid neglecting his work by declaring his illness even if the illness he says or alleges is not valid.

* Entrances and exits to workplaces and common areas connected to these places; Avoid behaviors such as pushing, making noises that disturb the comfort and peace of others, violating and insulting superiors and superiors, fighting, behaving indecently, and bringing guests from outside.

* Avoid actions that provoke or offend workers against the employer in the workplace.

* Keep the workplaces where they work and the common areas connected to these places clean, do not gamble, do not drink alcohol, do not carry or store weapons in these places.”

FIRST THEY WILL BE WARNED, THEN THEY WILL BE CUT OFF

The sanctions that will be imposed on workers if they act contrary to what is established in the contract were also explained in detail. Accordingly, workers will be warned first by their authorized superiors, but if they repeat these actions and actions again, “one to three days of salary will be cut depending on the degree of severity.”

However, if material damage occurs due to illegal actions and actions of workers, a “direct penalty for reduction of daily wages” will be applied.

In the contract; Precautions taken against the risk of firedamp were also included. The contract stated that “Methane drainage will be carried out in places where there is a lot of gas and early warning systems against both gas and fire will be installed, which will be sufficiently expanded and implemented.”

‘DEAD WORKER’S GUARD EQUIPMENT WILL BE RETURNED’

Attached to the contract was the “Directive on personal protective equipment to be provided to workers.”

Under the heading “Actions to be taken regarding unreturned personal protectors” of the directive, it was announced that personal protectors registered as fixed will be withdrawn. It was explained like this: Even if the worker dies, his personal protector will be returned to the employer:

“Personal protective equipment for workers who died, retired or dismissed for health reasons will not be recovered nor will its cost be recovered, and personal protective equipment provided as fixtures of the workplace will be recovered. b) Those who leave their jobs for reasons other than those in section a) will be obliged to return with them the goods subject to this directive. “For those who do not return these items within a short period of time, the balance fee will be calculated based on the remaining expiration date of the personal protection items and will be charged separately from the relevant parties.”

FINANCIAL RIGHTS

The economic rights that mining workers obtain under the contract are the following:

“On January 1, 2023, the daily gross salary of workers whose daily gross salary is less than 500 TL will be reduced to 500 TL.

In the first six months, 45 percent plus the inflation difference is added to the minimum daily gross wage, and in the second six months, 15 percent plus the inflation difference; “There will be a salary increase of 10 percent plus the inflation difference in the third semester and 10 percent plus the inflation difference in the fourth semester.” (PHOENIX)
