Can a resigned person receive compensation?

Compensation is of great importance to ensure that employees can continue to support themselves for a period of time if they are laid off. So, can employees receive compensation in the event of resignation?

CAN A RESIGNANT GET COMPENSATION?

The resigned employee cannot receive severance pay because he voluntarily terminated the employment contract. However, if the worker has a justified reason at the time of termination of the employment contract, he may request severance pay.

The employee may present the following as a reason for terminating the employment contract:

Serious and unfair behavior of the employer towards the employee

Failure by the employer to promptly pay the worker’s salary or social rights

The employer harasses the employee

The employer unjustifiably terminates the employee’s employment contract.

If the employee terminates the employment contract for justified reasons, the employer must pay him severance pay.

The employee who resigns must pay notice compensation to the employer. Notice compensation is compensation paid in exchange for the employee’s obligation to notify the employer in the event of termination of the employment contract. The amount of the notice payment varies depending on the duration of the employment contract and the employee’s seniority.

The resigned employee may file a claim for unfair dismissal against the employer. If the employer wrongfully terminates the employee, the employee can file a reinstatement claim. If it is decided to reinstate the employee as a result of the reinstatement case, the employee can claim severance pay and notice against the employer.

Consequently, the employee who resigns cannot receive severance pay, but if the employee has a good reason at the time of termination of the employment contract, he or she can apply for severance pay. Additionally, the resigned employee can file a wrongful termination lawsuit against the employer.
