Mediator’s ’71 Percent Rent Increase’ Solution

The landlord and the tenant, who were at odds over the rent in Izmir, shook hands at the mediation table on the condition of a gradual rent increase.

MD, the owner of the house in Çiğli, stated that the average rental price in the region where the apartment is located varies between 8,000 and 9,000 liras and asked his tenant, Atilla Figen, to increase his monthly payment, which is 1,750 lire.

When the parties could not reach a conclusion and the matter was taken to court, the mandatory mediation requirement came into effect.

After negotiations, the owner and tenant reached an agreement at the mediation table with the condition of a gradual increase.

THE 25 PERCENT LIMIT CONTINUES BUT…

According to the signed agreement, the tenant will pay the owner 3,000 liras per month until June 2024 and 5,000 liras between June and August.

Starting in August 2024, the rent will increase in proportion to the Consumer Price Index (CPI).

THE MEDIATOR HAS LOOKED FIRST SINCE SEPTEMBER

Lawyer and mediator İrfan Medet Akpınar said that since September, legal disputes arising from relations between tenants and landlords first go through mediation.

Akpınar stated that he first contacted the parties when he was assigned to present the dispute between MD and Atilla Figen: “There was a point where I was lucky that both parties had lawyers. “My fellow attorneys also contributed a lot to this process.” saying.

Akpınar stated that the parties, who have had a tenant-landlord relationship for 7 years, understand each other well and said:

“The landlord made an important contribution as he has been a tenant for many years and took into account our tenant’s special circumstances. Our tenant also made a great effort not to waste the opportunities and goodwill that the landlord offered him by imposing his own conditions. In the end an agreement was reached on a gradual increase.

The rental price was first increased to 3,000 lira, then to 5,000 lira, and in the last stage, an increase in the CPI was applied. We tried a lot, but the result was good. “Both parties shook hands amicably and left the table.”

TENANT DECLARATION

Tenant Atilla Figen stated that he has been paying rent regularly and has never had any problems with his landlord.

Figen says he is trying to make ends meet on his pension: “No one likes to fight. What I’m lucky is that my landlord is an understanding person. The situation is different when the mediator intervenes. “Both sides are doing the best they can,” he said.

LANDLORD’S ATTORNEY: AN ADEQUATE INCREASE HAS BEEN MADE

Ceyhun Yıldırım, the tenant’s lawyer, pointed out that mediation is not a new concept, but it has been recently applied in rental disputes.

Yıldırım said that they can reach a solution if the parties participate in the negotiations considering the possibility of reaching a compromise.

Haydar Tekinay, the landlord’s lawyer, stated that the 7-year relationship between tenant and landlord will continue through mediation, saying: “The parties were aware of each other’s financial situation and an appropriate increase was made. “We have reached a happy ending,” he said. (AA)
