An oral defense hearing was held at the Competition Board on the allegations of “cartelization” against 23 companies in the fresh yeast sector.

At the meeting at the Competition Authority, the President of the Authority, Birol Küle, said that an investigation was initiated to determine whether the enterprises that operate in the production and distribution of yeast violated the Competition Law when agreeing on prices and share customers.

The representative of the investigating delegation stated that the evidence and defenses obtained were evaluated within the framework of the pertinent legislation.

THE REPRESENTATIVE WANTED TO FINANCE 15 COMPANIES

The representative represents Mauri Maya, one of the fresh yeast producers, ensuring the implementation, coordination, continuity and control of agreements on price determination and/or distribution of clients/region among some companies that operate in the distribution of the product, and also determining the resale prices of the companies that operate in the downstream market, stated that it violated the article of the law and that it was assessed that an administrative fine should be imposed on this company.

Representative; Companies named Adatepeler, Barut Gıda, Batug, Çınar Gıda, Delice Turka, Güldemirler, Hamra, Haskat Gıda, Kılınçoğlu, Magpa, Motus, Muratlar, Öztürk and SHK Gıda must comply with the relevant law by setting prices and exchanging clients and regions. and limit the amount of supply.He stated that these initiatives are believed to have been violated and that an administrative fine should be imposed on these undertakings.

Representative; Çize, Gucbir, Oluyum, Orkide, Ozpak Denizli, Ozpak AŞ and Uludüz, stated that no conclusion and conclusion has been reached that there is no reason to impose administrative fines on these companies, since no proof of that they have violated the relevant law.

RECONCILIATION WITH THE LESSEE

The representative stated that the active cooperation and conciliation processes have concluded within the framework of the investigation carried out to determine if the companies that operate in the production and distribution of fresh yeast with the title of Lesaffre have violated the respective law through agreements to price determination. and customer exchange.

Noting that the company has requested conciliation, the representative stated that at the end of the conciliation process, it was decided to impose an administrative fine of 73 million 851 thousand 619.33 lire on Lesaffre and to conclude the investigation with a compromise on Lesaffre’s terms.

The representatives of the companies, against which sanctions are sought, argued that they had no illegal activities and that there was no infraction in specific facts.

The Board will announce its final decision on the investigation within 15 days. If the decision is made earlier, it will be announced on the website of the Competition Authority. (AA)
