Starts September 1st…Rental disputes will end in a month
With mediation, which has been made mandatory and will be implemented on September 1, approximately 80,000 rental disputes per year will be resolved in a month at most, without going to court.
With the Law on Foreclosure and Bankruptcy and the Law on Amendments to Certain Laws, promulgated by the Grand National Assembly of Turkey, mediation of rent disputes has become a condition of litigation.
MEDIATOR WILL BE APPLIED BEFORE OPENING A CASE
In these disputes, as of September 1, the parties will go to the mediator before filing a lawsuit. Requests will be made free of charge at the mediation offices of the courts. In the requests there will be no obligation to pay such as legal expenses, fees, witnesses, expert fees.
Mediation negotiations will be completed within three weeks. In mandatory cases, this period may be extended by the mediator for a maximum of one more week. If an agreement cannot be reached after negotiations, a lawsuit may be filed.
TOWARDS THE END OF 80 THOUSAND DISPUTES
About 80,000 rental disputes are expected to reach mediators annually. The application aims to resolve disputes with the consent of the parties.
Justice Minister Yılmaz Tunç, in his statement on the rental arrangement, stated that they wanted the disputes between the landlord and the tenant not to deepen.
Minister Tunç has stressed that rental disputes will be resolved peacefully without going to court. (AA)
