EU prepares to enact artificial intelligence law
The European Parliament (EP) has determined the content of the new law that will impose strict rules on various artificial intelligence technologies such as ChatGPT.
At the EP General Assembly session held in Strasbourg, the bill containing the first rules for artificial intelligence in Europe was discussed.
EP deputies accepted the document, which determines EP’s position in the negotiations to be held with member states on the artificial intelligence law, with 499 votes in favor and 28 against.
Consequently, artificial intelligence systems will need to be supervised by humans, not discriminate, be safe, transparent and respectful of the environment.
THE RISK-BASED APPROACH WILL BE APPLIED
A risk-based approach will be applied to artificial intelligence. Depending on the level of risk that artificial intelligence can represent, the rules will be stricter.

Consequently, artificial intelligence systems with an “unacceptable” level of risk in terms of personal safety will be prohibited. This will include artificial intelligence systems that classify people based on their social behavior or personal characteristics.
The use of real-time remote biometric identification systems in public places will also be prohibited.
Biometric triage systems using various sensitive characteristics, such as gender, race, ethnicity, nationality, religion, political orientation, profiling, location-based policing systems or past criminal behavior, emotion identification systems in law enforcement order, border authorities, workplaces and educational institutions, Establishment Internet databases or CCTV systems to create facial recognition databases will be prohibited.
High risk AI classification; It will be expanded to include damage to people’s health, safety, fundamental rights or the environment.
The use of artificial intelligence systems to influence voters in political campaigns will fall into the high risk category. Systems used by major social media platforms with more than 45 million total users will also be listed as high risk and these systems will be subject to strict rules.
ADDITIONAL TRANSPARENCY RULES WILL BE INSTALLED
Systems like ChatGPT will need to follow additional transparency rules. These systems should make it clear that the content is created by artificial intelligence.
Systems will be designed to prevent the production of illegal content.
Negotiations between the EU member states and the EP will start today, within the framework of the approved negotiating mandate. Legislative negotiations are expected to conclude by the end of this year.
Once the EU institutions have agreed on a common legal text, the law will enter into force by publication in the Official Journal of the EU.
THEY ARE IN CONTACT WITH COMPANIES THAT WORK WITH ARTIFICIAL INTELLIGENCE
The EU does not yet have a regulation on ChatGPT or similar artificial intelligence systems, but 2 years ago, the EU Commission prepared the first legislative proposal containing the framework for new rules on artificial intelligence and presented it to member states and the PE.
This proposal introduced some limitations and transparency rules in the use of artificial intelligence systems.
In the commission’s proposal, AI systems were divided into 4 main groups as unacceptable risk, high risk, limited risk, and minimal risk.
Separately, the EU asked tech companies last week to place descriptive labels on text and images produced by artificial intelligence.
Also, before the artificial intelligence law comes into force, the EU Commission is working on an agreement that will bring new rules in this field with the participation of all companies working in the field of artificial intelligence. This voluntary agreement is scheduled to be implemented until the artificial intelligence law comes into force. (AA)
