The product, which received an increase of about 12 thousand lira in 5 days, was canceled without any reason.
The same situation started to be seen on online ticketing sites that sell bus tickets.
The expectation of an increase in bus tickets also increased the complaints of cancellation without reason.
12 THOUSAND LIRA IN 5 DAYS; PRODUCT CANCELED
Emin Özkan, who lives in Istanbul, explained that the product he bought on the e-commerce site was canceled after shipping:
“I ordered a smart watch from a well-known brand for 24 thousand lira.
I received a call from 0850 number from this e-commerce site on Monday morning: ‘Sir, you bought a smart watch, I entered the wrong price, the product increased, please cancel your order.’ I said I couldn’t either. The product was shipped on Monday.
When I track the cargo, it always shows on the transfer and the product never arrived.
Then a message came that your order has been canceled, your money has been refunded. The returned money will be returned in 6 months since it is withdrawn in installments.
This product is now 36,500 liras because the foreign currency has increased. Frankly, they didn’t give our product victimizing the customer because the product was increased. I have a loss of 12 thousand liras in 5 days.
I think many citizens are also victims of e-commerce sites due to rising currencies.
I am waiting for my product to be shipped to me or for the difference between the price on the date I purchased the product and today’s price to be paid.” he recounted his experiences.
When asked about Özkan’s complaints, the e-commerce site claimed that they were interested in the issue, that there was a problem caused by the selling company, and that the price difference would be refunded to Özkan.
ENTRY CANCELED DUE TO LACK OF PLACE
Yağız Kalemci, whose bus ticket was cancelled, said, “My ticket has been canceled before. They gave a reason why there was no room. Although we bought the ticket, we had a problem, they called us and said that there was no place. They got their money back. We were victims, we couldn’t get there on time. We left after 2 days. After that, we didn’t buy tickets on that website,” he said.
Sevda Demir said: “We usually buy it online, but it hasn’t been a problem. I canceled it myself, but they didn’t have a situation to cancel. If something like that happened to me, I would be very angry, I would complain.”
I CAN’T SAY ‘I’M CLOSE, I’M NOT SELLING’
Making statements on the subject, Consumer Confederation Chairman Aydın Ağaoğlu said, “The justification for canceling the consumer contract can only be due to force majeure. Article 6 of the Consumer Law also prohibits refraining from selling. “I’m not going to sell, I’ve given up, you can’t say you’ll get your money back,” he said.
Ağaoğlu, emphasizing that price increases cannot be made with excuses, said: “If the order is canceled without good reason, the Internet sales portal has to pay the difference in price to the consumer.”
‘THE CONSUMER MAY DEMAND MATERIAL AND MATERIAL COMPENSATION’
“If you have to pay a difference to make that trip, the consumer can definitely go to the arbitral tribunal and request that the price be returned with anticipated commercial interest.
There is a clear provision in the Consumer Law. Consumer contracts cannot be modified to the detriment of the consumer. It is also prohibited to avoid selling. In our article 54 on the price tag, it says; If the requested price and the box price are different, the one in favor of the consumer is applied. The law is very clear and the hand of the consumer is very strong.
The consumer must file a claim with the Ministry of Transport for intercity travel companies that cancel the ticket they purchased. If the consumer cannot make that trip, the right to material and moral compensation arises.
‘THE DIFFERENCE IN PRICE MUST BE PAID TO THE CONSUMER’
Ağaoğlu said: “Just as the seller cannot cancel intercity bus tickets purchased both on the Internet and at the terminal, the dollar has risen, and some companies cancel orders from consumers who request electronic products. This is completely against the law,” he said.
“Goods that are not in stock cannot be sold, there is a clear provision in the distance contract regulations. Ağaoğlu said: “We also see a lot in online shopping.

The recipient of consumers are Internet sales portals where they pay the price through distance contracting. Article 6 of the Consumer Law prohibits refraining from selling.

It is completely against consumer law to arbitrarily cancel it and change the sticker price and put it on sale. If consumers encounter cancellations related to travel companies, they can file a complaint with the Ministry of Transport against their will, and with the advertising board of the Ministry of Commerce if they see a cancellation or unfair practice regarding their online purchases. ”.
