Those who repeat exorbitant prices will be fined twice

If, within a year, the exorbitant pricing and stockpiling practices determined as a result of the evaluation by the Unfair Prices Evaluation Board are repeated, an administrative fine equivalent to twice the previous sanction will be applied.

Modifications have been made to the Regulations of the Unfair Prices Evaluation Committee regarding the operating principles of the Unfair Prices Evaluation Board, which will operate in times of emergency, disaster, economic fluctuations, and other emergencies.

Through a paragraph added to the norm published in the Official Gazette today, it was established that if the infraction that entails administrative fines is repeated within a calendar year, the administrative fine will be double the previous sanction for each recurrence.

THE SIZE OF THE BENEFIT OBTAINED WILL ALSO BE CONSIDERED

With another regulation made by the regulation, the actions specified as “acts” during the determination of the amount of the administrative fine were changed to “lack”.

According to the text of the new article, when determining the amount of the sanction by the Unfair Price Evaluation Board in the execution of administrative fines, issues such as abusiveness, recidivism and number of the offense, the amount of the benefit and damage caused by reason of the fault, the fault of the author and his economic situation will be taken into account.

With the regulation, the reference made to the retail trade regulation law was modified, which constitutes the basis for the imposition of the administrative fine as a result of the Board’s evaluation.

THE STORAGE FINE WILL BE UP TO 2 MILLION TL

In accordance with this regulation, to determine the administrative fine that will be imposed on manufacturers, suppliers and retailers that are determined to be acting in violation of the specified obligations, paragraph (k) will be taken as the basis instead of paragraph (i). of article 18 of the law on the regulation of retail trade.

According to the previous paragraph, from TL 10,000 to TL 100,000 for each violation of exorbitant pricing practices; In the case of hoarding, activities that disturb the balance of the market and free competition, and activities that prevent the consumer from reaching the goods, an administrative fine of TL 100,000 to TL 2 million is expected to be imposed for each violation.
