The “Bill on the Amendment of the Law on Organized Industrial Zones and Some Laws”, consisting of 24 articles, including execution and enforcement, was submitted to the Presidency of the Grand National Assembly of Turkey, with the signatures of AKP deputies.

In the bill’s general justification, “Its goal is to create a competitive market that is trusted by domestic and foreign companies that will trade in the Turkish natural gas market and that will operate according to objective rules.

In this context, natural gas imports are liberalized both for BOTAŞ and for legal entities in the private sector. The proposal, which foresees changes in the current structure of BOTAŞ, includes the establishment of companies, etc. for this restructuring. It includes the granting of powers.

NO RESTRICTIONS WILL APPLY

Under the proposal, there will be no transmission fees for exported natural gas and no restrictions on domestic transmission fees.

Transit transmission fees and export-related transmission fees may be determined by EMRA in accordance with procedures and principles different from other fees.

It was also stated in the general supporting statement that the relevant regulations were in line with Turkey’s “aim to become a natural gas hub”.

OBJECTIVE TO ACCELERATE INDUSTRIAL INVESTMENTS IN OIZs

On the other hand, with the bill that consists of 24 articles, which includes regulations for organized industrial zones (OIZ) and the energy field, it is intended to speed up the processes of planning, establishment and expropriation of the OIZ in order to speed up industrial investments. to be carried out in the OIZ.

‘Green ZIO’ is defined and regulations are drawn up for green ZIOs to be certified by the Turkish Standards Institute (TSE) under the criteria determined to accelerate green transformation and grant credit to projects prepared by ZIOs to meet OIZ green criteria.

Its objective is to broaden the scope of the institutions and organizations that will participate in the establishment of the OIZ and to establish stronger OIZs in terms of institutional and financial strength.

A pre-allocation request is organized for OIZs to meet their resource needs at the establishment stage. It is foreseen that the adjudication and sale of parcels in the ZIOs will be carried out in accordance with the principle of transparency and the procedures and principles that are determined in the secondary legislation.

In addition, it is intended to put into production the empty plots in the OIZ and make the areas with the accompanying industrial structures provided for by the OIZ declaration.

FACILITIES WITHOUT A LICENSE WILL BE COVERED BY THE INFRASTRUCTURE FACILITY

It is expected to eliminate the differences of interpretation through the drafting of the regulation on the exemption of all types of legal fees and the obligation to give guarantees to the institution in trials and procedures in which the EMRA is a party, and in requests for measures precautionary and preventive embargoes.

With the regulation carried out, it is ensured that the transmission rates related to exported natural gas are not subject to the restrictions to which domestic transmission rates are subject.

At this point, the EMRA is granted the authority to establish different procedures and principles in relation to export-related transmission rates on issues such as security of supply, improvement of the competitive environment in the market and system operation, provided that the opinion of the Ministry of Energy and Natural Resources is taken.
