Warning to insurance companies that do not make insurance under the pretext of earthquake risk
Mahmut Şahin, Chairman of the Consumers’ Union, said that those who want to have auto insurance for their vehicle and home, except for the 11 provinces affected by the earthquake, were rejected by some insurers under the pretext of “earthquake risk”.
Şahin stated that insurance companies have the right not to take action in 11 provinces that were destroyed by the earthquakes in Kahramanmaraş.
Emphasizing that insurance companies should take action for anyone who wants to, Şahin said: “It is not right to avoid car insurance because of the possibility of an earthquake in a city that has not suffered damage, it is wrong.” Insurance companies do not have that right,” he said.
‘CIMER COMPLAINT’
Emphasizing that there is a legal arrangement in the law on this issue, Şahin said:
“The Consumer Protection Law No. 6502 says it very clearly. It says that vendors and suppliers, people who sell goods and services, institutions can never help but sell it. Currently, there are no earthquakes in Kayseri, no earthquakes in Yozgat, and no earthquakes in Ankara. There can be no practice like not having insurance because there is an earthquake risk here.”
Emphasizing that those who find themselves in such a situation should file a complaint with the Ministry of Finance and Finance or CIMER, Şahin made the following assessment:

“Let’s say the consumer applied to a company for insurance, but the company said they couldn’t make the insurance. In such a case, the company should be asked in writing why the insurance will not be made. If the process is documented in this way, the company may be required to cover damages from any negativity that is experienced. Let our consumers know that they have rights in this regard. Sellers may also face criminal penalties associated with this. The Ministry of Finance will certainly not leave such a situation unanswered. There is no such thing as avoiding a sale.”
Şahin noted that after the earthquake, many people applied for insurance from the Natural Disaster Insurance Institution (DASK).
Şahin, who also warned those who will take out TCIP insurance, said:
“When we talked to insurance companies, we realized that consumers were missing something in this regard. We have heard that there are consumers who agree to reduce the square meter so that the premium does not go up.
A citizen who lives in a house of 150 square meters calls his house of 50 square meters so that my premium is low. But he must know that he will receive payment for 50 square meters in a possible demolition. Insurance companies reimburse the construction cost per square meter in areas where destruction is in question.
For example, the construction cost of a house of 150 square meters is 400 thousand lira and its market value is 1 million lira. The insurance company reimburses the consumer for the cost of construction. The Ministry of Treasury and Finance has the power to intervene in this matter.
