Bankruptcy decision issued for Atlasjet again

Atlasjet employees continue their search for rights and justice, which has been going on for approximately 3 years. From the date of Atlasjet’s bankruptcy filing on February 14, 2020 to today, former Atlasjet employees’ wages and receivables were unpaid and left vulnerable before the pandemic, despite promises to pay personally by Patron Murat Ersoy.

In the hearing of the lawsuit, which was held yesterday, the Mercantile Court once again resolved the bankruptcy of the company. Thus, in the process that has effectively come to an end, the judicial process for the victims has been started again pending the outcome of the appeal.

HAVASEN, which closely monitors the process for Atlasjet victims to obtain their rights, made a statement after the hearing. In the written statement, the point reached in the process was summarized as follows:

  • The case of Atlasjet Airlines, which Turkish civil aviation will likely be referred to as “fraud bankruptcy”, was held at the 3rd Commercial Court of First Instance at Bakırköy Palace of Justice on June 17, 2021.
  • After its examination, the Regional Court of Justice reversed the decision and returned the case to the 3rd Commercial Court of First Instance at the Bakırköy Palace of Justice on the grounds that Atlasjet’s Board of Directors did not make a bankruptcy decision under the Commercial Code from Turkey 376/3, which was not in the file, and which was missing.
  • Atlasglobal Bankruptcy Case was heard again at Bakırköy Courthouse 3rd Commercial Court of First Instance on January 19, 2023, and it was recorded in the report that the bankruptcy decision, which was declared incomplete, was actually on file, overlooked by the higher court. Thus, in the process that has effectively come to an end, unfortunately, the judicial process for the victims has been reinitiated pending the outcome of the appeal.
