6 months and 6 thousand kilometers begins condition for sale of used cars

According to the letter made by the Ministry of Commerce, according to the regulation made on August 16, 2022 in the Regulation on the Trade of Second-Hand Motor Vehicles, the marketing or sale of automobiles and land vehicles in the field of commercial activity , provided that 6 months and 6 thousand kilometers have elapsed since the date of the first registration of these vehicles.

WHEN DOES THE 6 MONTHS AND 6 THOUSAND KILOMETERS CONDITION BEGIN?

In this context, the term for the marketing or sale of automobiles and land vehicles registered in the name of those engaged in the sale of used land vehicles before August 16, 2022 will expire on September 15, 2022. After 6 months and 6 thousand kilometers from this date, the marketing and sale of these vehicles will not be possible until July 1, 2023.

As of September 15, 2022, the marketing and sales restriction inspections will begin for those engaged in the trade of used motor vehicles.

SALES RECORDS WILL BE FOLLOWED

The inspections for the regulation, known as the 6-month, 6,000-kilometre marketing and retail restriction, will be carried out by the Ministry of Commerce through 3 different channels.

Second-hand motor vehicle sales records submitted to the Ministry of Commerce with full details by the Turkish Notaries Union will be followed daily.

Starting tomorrow, sales made daily for 6 months and less than 6 thousand kilometers will be tracked and controlled through query screens through the corresponding information system. A direct administrative fine will be applied to each sale within the marketing and sale restrictions of those who are engaged in the trade of second-hand motor vehicles with an authorization certificate.

In the field of commercial activity (more than 3 sales in a calendar year), the sales of natural or legal persons who sell automobiles and land vehicles directly or by proxy without an authorization certificate for 6 months and less than 6 thousand kilometers will be determined. and an explanation of said sales will be requested.

As a result of the examination, an administrative fine will be applied to natural or legal persons who make sales for each of these sales, which are determined to be made in the scope of commercial activity. These people will also be sanctioned for engaging in the trade of second-hand land vehicles without a license.

In the audits carried out on the sales records, the obligation to obtain an appraisal report and present this report before a notary public will also be verified.

Whoever sells cars and ATVs in the field of commercial activity, with or without authorization certificate, is obliged to obtain an appraisal report no later than 3 days before each sale and present this report to the notary during the sale. An administrative fine will also be imposed on those who do not comply with this obligation within the framework of the inspections that the Ministry of Commerce will carry out on sales records.

WORKPLACES WILL BE INSPECTED

Starting tomorrow, through the Provincial Directorates of Commerce, work inspections will be carried out on automobile dealers, car rental companies and authorized dealers in 81 provinces, and the marketing and sale activities of vehicles under 6 months will be reviewed and 6 thousand kilometers.

The inspections of the workplaces that will be carried out by the Provincial Directorates of Commerce will continue periodically with all the companies that operate in this field.

In addition, the Provincial Directorates of Commerce will carry out direct inspections of the workplace in the area of ​​complaints about the sale or marketing of vehicles within the scope of the 6-month and 6,000-kilometre restriction.

In the event that activities related to the commercialization of vehicles within the scope of said restrictions are detected in these companies, the situation will be registered and presented to the Ministry of Commerce together with the information and supporting documents on the violation of the norm.

VEHICLE ADS WILL BE INSPECTED

Advertising information about the vehicles marketed on the advertising sites will be regularly obtained from these sites, and such marketing and sales activities will be monitored.

As a result of monitoring, control and inspections, car dealers, car rental companies, authorized dealers and all natural or legal persons who make sales in the field of commercial activity, separately for each sale, administrative money for 6 months and 6 thousand kilometers a penalty will be applied. AA
