Germany passed the law approving the “brain drain” of skilled immigrants. The law, which was approved on Thursday by the coalition of the Social Democratic Party, Greens and Liberals, has 101 pages in total with its preliminary and complementary articles. The implementing regulations are currently being prepared.

SÖZCÜ had previously announced the final draft of the law. The draft was approved in the assembly without many changes, but there were some revisions. The title of the new law published in the Official Gazette is “Quality re-education-development of immigrants”. The law, which modifies many articles at the same time, aims to “receive qualified and educated immigrants” from outside the EU.

LITTLE BUREAUCRACY AND OPPORTUNITY CARD: Like Canada and New Zealand, a 10 point system is introduced and the person who gets at least 6 points will be able to come to Germany with a blue card and visa. If you find a job, you can stay. Criteria such as “know German (or English), find a suitable job, age, education or experience, show that you can adapt, have a relative in Germany” will earn points. Bureaucracy in hiring will be minimized. Skilled immigrants will receive an “Opportunity Card” and have the right to work for one year. If your employment contract is extended, the period will be extended and a residence permit will eventually be issued.

THEY DON’T WANT THE EMPLOYEES TO COME TO THE US AND CANADA: Educated people who prefer the US or Canada to Germany will be drawn to the country. In addition to cutting red tape, it aims to make working in the country more attractive and create a more hospitable environment. For example, until now, a nurse had to complete an average of 17 separate paperwork to be able to come. This will be easier.

EXPERIENCE OR WORK EXPERIENCE: Those who are experts in a field in Turkey, have at least two years of work experience and have a diploma in this field will be able to go to Germany if they find a job. This requires a paid job offer. The person may continue to work in Germany until their degree or specialization is recognized. It is planned to recruit 1,200 nurses in the first phase.

CHANGE IN THE BLUE CARD SYSTEM: The system of taking educated people with the Blue Card, which has been implemented in Germany for 11 years, will continue. University graduates from non-EU countries will be able to come to Germany if they have found a job with a gross salary of 43,800 euros per year or if they have received a job offer. Previously, the minimum wage limit was 58,400 euros gross.


EXPERTS IN IT AND JOB CHANGE: Those who come with the Blue Card may benefit from the right to family reunification and obtain a permanent residence permit. In addition, you may perform in a position that requires other qualified personnel. It is possible to change profession. For example, an office manager may be a logistics specialist. Computer scientists and IT professionals will be able to work with the EU Blue Card without a university degree if they prove knowledge of programming and computer science.

ADVANCES FOR EDUCATION AND LEARNING: Germany, which also wants to increase educational migration from non-EU countries, has also made it easier for those who come for education and vocational training to stay. Foreign students will be able to work as interns in Germany to earn a living. If necessary, additional time will be given to search for employment. The maximum stay for a residence permit will be increased to nine months. Work and trial periods will be allowed.

LANGUAGE SKILLS AND QUALIFICATION: The most important objective of the “Lucky Card” that will be given to the new generation of immigrants is to bring a right based on the point system. University graduates with at least two years of professional training may obtain this card. A minimum of 6 points is required to get an opportunity card, and this will also be extended when the employment contract is extended. The language requirement has been softened and instead of B1 or B2, A2 and A1 level language will suffice.

FAMILY AND PARENTS MEETING: Those who settle for work in Germany and obtain a residence and work permit will benefit from the right to family reunification. This right will not be limited to the “nuclear family” alone. In other words, in addition to the spouse and children, parents and even the mother-in-law can be brought. In more than 60 years of immigration history, Turks were not allowed to take their parents with them. This was a great innovation.

COME AS TOURISTS: Until now, Germany was handling the issue of visas very closely. This time, instead of tourist visas, the emphasis will be on skilled immigrant visas. The tourist visa will also continue. Those who have come to Germany as tourists will be able to obtain a work and residence permit if they have found a suitable job and can prove their experience. Until now, people in this situation were required to leave the country and obtain a visa again.

VOCATIONAL EDUCATION FOR REFUGEES: Those who came to Germany illegally seeking asylum or seeking asylum for other reasons will be able to stay if they “find a job”, even if their application has not yet been accepted. Your status will be legalized. For this, the application date of the asylum seeker must be before March 29, 2023.

RECRUITMENT FROM THE BALKANS: The regulation, known as the Western Balkans Regulation, expired at the end of this year. This will spread. 25,000 workers were recruited from Albania, Bosnia and Herzegovina, Kosovo, North Macedonia, Montenegro and Serbia. They will take 25 thousand more.
