Visa move from Germany: How will the new generation of labor migration work?
Germany is activating the “Skilled Work Law” and the new “Citizenship Law” together to keep up with the changing world and close the labor shortage.
Since the parliament is expected to pass the law in a short time, almost 7 million “skilled migrant workers” will be recruited from non-EU countries, especially Turkey, in 7 years.
On the one hand, tourist visas are not granted, and on the other hand, the enactment of such a law is confusing.
THOSE NOT QUALIFIED WILL BE ELIMINATED
Germany and the EU, with their strict visa policy, are blocking people who “are not qualified and think they can be a burden on society.”
On the other hand, it introduces a new “National Visa System” to “obtain qualified personnel”. While the Schengen visa hardens or “slows down”, the “National Visa” will be accelerated after the entry into force of the new legal regulation.
The new law brings important changes to the immigration law, the residence law, the laws on social rights and the citizenship law, in particular the system of hiring Turkish and foreign workers with the “Blue Card” implemented by the EU.
If all 300+ pages of the new bill we reviewed are approved, the system will work as follows:
1) ADEQUATE CONDITIONS TO FIND WORK: The first condition for going to Germany and other EU member countries is to be able to find a job suitable for vocational training or the profession to which one has become accustomed over the years. With this job offer, “National Visa” will be applied. The workplace will also send “invitations” from Germany to the consulates in Turkey. As with doctors, a certain level of German or English is required. Those who find a job and settle down will be able to take their family with them.
2) LOWER SALARY LIMIT 3500 EURO: Those who want to come to Germany with a job offer must have received a gross offer of at least 3,500 euros. Offers below this may be granted in “exceptional circumstances” and for a short period of time. But that is the main application. IT professionals, healthcare professionals, experts in the construction industry, water and heating installers, and those with a profession in every conceivable field are welcome to apply.
3) OPPORTUNITY TO CHANGE PLACE OF WORK: Those who come to Germany with the invitation of a workplace will be able to change their workplace after a certain period of time, if they do not wish to. You can even move to another EU member state. There are two limits of one year and three years. After three years, a permanent residence permit can be obtained. After 5 years, you will become a German citizen. The system will operate very differently from labor migration in the 1960s. This time, the target is “educated staff and brain drain,” not workers.
4) REFUGEES AND ESCAPEES: Turks who smuggled into Germany and applied for asylum will benefit from their rights if they have applied by March 29. In other words, if they find work, they will have a residence and work permit. Your status will become legal. It is not expected that these will seek the lower limit of 3,500 euros. I mean, they can even work if they get a construction job.
5) STATUS OF INVISIBLE WITH TOURIST VISA: Those who have not received an invitation or job offer from Germany but have come as tourists may also benefit from the same right. They will be able to obtain a work and residence permit if they find a suitable job in Germany and can guarantee that they will earn a certain income.
6) PERMANENT RESIDENCE AND CITIZENSHIP: The Turks have a different situation than other non-EU countries. The Association Agreement signed with the EU and the resolutions of the Association Council numbers 1/80 and 1/83 and the model decisions of the Court of Justice of the European Union provide for the right of Turks to settle in the EU within a short period of time . This brings the EU permanent residence permit after a period of three years. So citizenship is possible.
7) SCORING SYSTEM AND SERVICES: In order for the Turks to come to Germany, they will have to find a certain score. According to the system called Chance Card, having a job, knowing the language, having a family member in Germany, being under 45 years of age, getting a good job offer; together with a positive score will be effective in obtaining a National Visa. Seniors can also come if they meet the other conditions.
