ECtHR finds France guilty of ‘inhuman treatment’
The European Court of Human Rights (ECHR) found France guilty in two cases for “exposing inhuman treatment” of babies and children of different nationalities in the detention center to be deported.
Based in Strasbourg, the court has announced its verdicts in two cases brought against the conditions of detention of two Guinean and Angolan mothers with their babies and children in the detention center. The Court considered that a Guinean mother and her 7.5-month-old baby were subjected to inhumane conditions in the detention center, where they were held for 9 days, to be deported to Spain in 2021 by decision of the Governor of Bas-Rhin, considering the age of the child, the conditions of stay and the duration of detention. came to the conclusion.
Thus, the ECHR decided that article 3 of the European Convention on Human Rights (ECHR) was violated, which “prohibits inhuman and degrading treatment”, and ordered France to pay a fine of 19,000 euros to the defendant.
In the second case, the ECHR ruled that an Angolan mother and her 3 children aged 8 months, 6 and 13, who were held in the detention center for 10 days in 2020, will be deported to Portugal by order of the same governorate. They were subjected to similar treatment.
Convinced that the French state violated the law despite warnings from the Council of Europe, the court ruled that the defendant must pay 8,000 euros for material damages. The ECHR also pointed out that in both cases, articles 5.1 of the ECHR were violated, which contemplates the “right to liberty and security”, and articles 5.4, which stipulate that the “legality of the detentions must be decided on the spot”. .
