The EU rejects the PKK’s request to be removed from the terrorist list
The General Court of the EU, which is affiliated with the Luxembourg-based Court of Justice of the EU, announced its reasoned decision on the lawsuit filed by the PKK last year.
In the decision, which defined the terms “terrorist act” and “terrorist group”, the organization was stated to be a “terrorist organisation”, referring to the 2014 UK and 1997 US decisions. and 2001 that banned the PKK.
In the decision, it was stated that the actions of the PKK could not be counted within the ambit of the “right of the Kurdish people to self-determination” and that recourse to armed force for the general exercise of this right could not be considered legitimate.
In the Court’s decision, it was emphasized that “an exception to the prohibition of terrorist acts in armed conflicts has no basis in EU or even international law”, and it was recalled that the PKK’s attacks on tourist facilities were aimed at to the civilian population.
The decision also affirmed the EU Council’s assessment that the terrorist risk vis-à-vis the PKK continues.
Therefore, the Court of Justice of the EU has fundamentally rejected the PKK’s claim against the Council of the EU.
The European Council reviews the list of sanctions such as freezing the financial assets of individuals, organizations and organizations considered to be terrorists and prohibiting the provision of financial resources at least every 6 months.
