Giuliani alleged massive election fraud but had no evidence, the three-member panel wrote in a report detailing the errors and unsubstantiated claims the former mayor made in a Pennsylvania lawsuit to reverse the loss of the Republican president to Democrat Joe Biden to make.

Between Election Day and the January 6, 2021, riot in the U.S. Capitol, Giuliani and other Trump attorneys repeatedly filed claims of election fraud that were almost uniformly rejected by federal and state courts. He is the third lawyer who could lose his legal qualification because of what he did for Trump: John Eastman faces suspension in California and Lin Wood surrendered his Georgia license this week.

Mr. Giuliani’s efforts to undermine the integrity of the 2020 presidential election helped destabilize our democracy, wrote the panel, Robert C. Bernius, Carolyn Haynesworth-Murrell and Jay A. Brozost.

The misbehavior here sadly surpasses any of his previous achievements, they wrote. It was unparalleled in its destructive purpose and effect. He tried to disrupt a presidential election and persists in his refusal to admit the wrong he did.

Giuliani has already been suspended for false statements he made after the election. The work of the Washington review panel now moves to the DC Court of Appeals for a final decision.

Giuliani’s post-election work has made him a key figure in several federal and state investigations. He met with the special counsel assigned to investigate efforts to overturn the 2020 election and Fulton County prosecutors.

The three-judge panel examined a case brought by Giuliani on November 17, 2020,

days after the Associated Press and other news outlets declared the election for Biden.

The Trump campaign complained that Philadelphia and six Democratic-controlled Pennsylvania counties allowed voters to make corrections to ballots that would otherwise be disqualified because of a technicality, such as the lack of a non-disclosure envelope or a signature. Some other provinces did not follow suit.

Giuliani argued the case. Though he had once served as a U.S. attorney in New York, the Pennsylvania feud was his first trial as an attorney since 1992, the year before he was elected mayor of New York, according to federal records.

He spent much of the hearing groundlessly alleging a national conspiracy to steal the election from Trump, something the former president continues to argue to this day.

As Trump’s election processes fizzle, Giuliani heads to court. It’s not getting better

U.S. District Judge Matthew Brann rejected Giuliani’s arguments days later, noting that the Trump campaign had wanted him to throw away millions of votes.

One might expect that in seeking such an output a plaintiff would be formidably armed with compelling legal arguments and factual evidence of rampant corruption, Brann wrote at the time. That didn’t happen.

The panel’s review on Friday said Giuliani “did not provide any evidence that fraudulent mail-in votes were actually cast or counted,” but instead drew its own conclusions.

Mr. Giuliani’s argument that he didn’t have time to fully investigate his case before submitting it is particularly unimpressive, the panel wrote. “He tried to turn the presidential election upside down, but he never had any evidence to support that effort.”

The panel said Giuliani had violated a rule that prohibits lawyers from engaging in conduct detrimental to the administration of justice.

Clogging the courts with unnecessary and frivolous matters is such an offense,” the panel said.
