Ankara Chamber of Commerce (ATO) Real Estate Committee Chairman Kenan Bayram stated that an arbitration panel made up of real estate consultants will act as experts in cases submitted to arbitration due to rental disputes.

Bayram said the mandatory mediation period for rental, condominium, partnership dissolution and neighborhood disputes began on September 1, and in these cases the requirement to go to a mediator before filing a lawsuit was introduced.

Bayram stated that real estate consultants will also be authorized in cases that are not resolved in mediation and are moved to arbitration, thanks to the work carried out by the Union of Chambers and Commodity Exchanges of Turkey (TOBB) and ATO, and stated that it is important for the sector to get involved in the process.

‘WE WILL SOLVE OUR OWN CASES AND WRITE A REPORT’

Bayram stated that real estate consultants will prepare reports as experts in disputes and said:

“If arbitration is provided for in contracts, disputes will be submitted to arbitration. Here real estate advisors selected and approved by the management and board of the chamber of commerce become experts and prepare reports on disputes in real estate law. This promotion represents a revolution for the real estate sector. So now we can solve our own cases and write reports. The results will be evaluated according to these reports.”

Bayram emphasized that the real estate advisors who will participate in the delegation will be licensed consultants who have served a certain period of time in the profession.

‘COURTS ARE TAKING YEARS’

Explaining that the participation of real estate consultants in this process will contribute to both the market and citizens, Bayram made the following assessment:

“Disputes arising from contracts could take years in court. These will now come to mediation. If an agreement is not reached within 3 weeks, it will go directly to the arbitration committee. For example, the one we agreed upon will be sent to the TOBB Arbitration Committee. “Disputes will be resolved as quickly as possible with reports provided by our property consultants within our industry, who are selected by ATO management and council as part of the arbitration panel.”

Bayram stated that within the scope of the program prepared in cooperation with TOBB lawyers and the ATO Real Estate Committee, the process will be explained to real estate consultants during the training they will carry out in the Assembly Hall of the ATO. ATO on September 26, saying: “We will then select and send a panel of arbitrators from our colleagues to the arbitrations. The participation of our colleagues is important in determining the arbitration and mediation experts we will choose.” saying.

Noting that the status and limits of real estate consultants are determined within the scope of the Regulation on Real Estate Trade, Bayram said:

“The most important issue here is the competencies of the real estate advisor. These powers are limited by the real estate trade authorization certificate obtained by the Ministry of Commerce. All our colleagues who receive this document can sign real estate contracts, provide purchase and sale intermediation services and obtain a contract from the owner of the property, and publish ads on advertising portals and social networks. “We cannot call real estate agents those who do not have a certificate.” (AA)
