The Union of Turkish Bar Associations filed a lawsuit demanding the cancellation of the VAT and SCT increase.
In the pronouncement of the TBB, it was alleged that the regulation on the VAT increase was far from the principle of fair balance stipulated in article 73 of the Constitution, and that it contained content that could lead to the violation of the rights of claim and the right to property.
It was argued that the regulation would create an obstacle to citizens’ right of access to the courts, by providing for an increase in legal costs and fees.
It was alleged that the regulation and the foundation of the law on the increase of the SCT are contrary to article 73 of the Constitution, which grants tax power to the legislative branch, and to article 2, which enshrines the principle of legal certainty.
For these reasons, it was reported that two separate lawsuits were filed in the Council of State for the nullity and suspension of the execution of the Presidential Decisions related to the increase in the amounts of VAT and SCT.
In the lawsuit, it was also requested to request the Constitutional Court to nullify the norm and the nullity of the legal provision on which it was based in terms of the norm on the increase of the SCT. (AA)
