In today’s edition of the Official Gazette, the general collection communiqué was published, which determines the principles regarding some articles of the misdemeanor law, including the provisions on the application of administrative fines.
ADMINISTRATIVE FINES CAN BE PAYED IN 4 EQUAL INSTALLMENTS
According to the Communiqué, administrative fines may be requested to be paid in installments within the payment term if the economic situation of the recipient is not suitable. The fines will be paid in 4 equal installments and the first installment will be paid within the term for payment of the administrative fine, and the remaining three installments will be paid within 1 year from the date of notification of the fine, within a term to determinate. by the unit that imposed the fine.
If the installments are not paid on time and in full, the remaining part of the administrative fine will become due and be followed. However, since the installments of administrative fines, which are subject to the condition of being terminated, are not paid in due time, the remaining part of these fines can be tracked on the condition that the sanction is terminated. .
If the administrative fine is paid within the payment term, a reduction of 25 percent of the fine will be made. The fact that the fine has been paid will not prevent legal action against the sanctioning administrative resolution in due time.
LOAD WAITING PERIODS
According to the Communiqué, the limitation period for the collection of administrative fines; It will be 3 years for those with less than TL 10,000, 4 years for those between TL 10,000 and TL 19,999, 5 years for those between TL 20,000 and TL 49,999, and 7 years for those with TL 50,000 or more. .
The prescription will begin to run from the beginning of the calendar year following the calendar year in which the administrative sanction ends. In the event that the administrative sanction cannot be initiated or fulfilled in accordance with the pertinent legal provision, the prescription will not run.
In the event that the limitation period expires, taking into account the circumstances that interrupt and stop the limitation period, administrative fines will not be followed and the collection of these fines will be waived. However, payments made after these consent periods will be accepted.
THE PENALTY WILL NOT BE ON THE HEIR
In accordance with the principle of the individuality of penalties, in the event of the death of the natural person subject to the administrative fine, these penalties will not be followed by the heirs and the collection of penalties will be waived.
If the administrative fines imposed on the natural person before or after the date of death are communicated to the Treasury for follow-up after the date of death, said fines will be returned to the unit that imposed the sanction by the Treasury. The administrative fines that were declared for follow-up before the date of death, on the other hand, are not followed by the Treasury of his heirs and the collection of the fines is waived.
In the event that the administrative fine imposed on the legal person cannot be collected from the legal person’s estate, if the person actually responsible for the payment of this debt dies during the monitoring process, this debt will continue to be followed by the heirs of the person real that they have not refused the inheritance. This provision shall also apply to judicial fines.
