In today’s edition of the Official Gazette, the Presidential Decree on some measures adopted in the field of disaster and emergency management in the field of state of emergency (OHAL) was published.
In accordance with the decree, the TCIP will not be sought for the construction of these structures or the provision of credit for disaster victims who have houses, workplaces and sheds destroyed or severely damaged in places considered disaster areas, provided that have rights and are debited in accordance with the provisions of law number 7269.
In the reconstruction of homes, workplaces and other constructions or in obtaining loans, the restrictive provision that establishes that the owners of buildings that construct buildings without obtaining a construction permit on land or land that does not belong to them will not apply. , and owners of buildings built without a license in locations determined to be objectionable in the zoning plan, will not be accepted as beneficiaries.
RIGHTS OWNERSHIP ANNOUNCEMENT WILL BE MADE
An announcement on the application for the right of those who wish to grant a construction loan or build a building using law number 7269 in places considered as disaster areas will be announced on the website of the Presidency of Disaster and Emergency Management and the beneficiaries. disaster. you will be required to apply within 2 months. This period can be extended by a maximum of 1 month if necessary.
The results of the application will be announced by the corresponding civil administration on the website of the Presidency of Disaster and Emergency Management and on the e-Government portal. Those whose rights are not accepted can appeal within 15 days.
EXCEPTION FROM TAXES, FEES, FUNDS AND LIABILITIES
In accordance with the decision, due to the execution of projects to be financed with loans and donations from international organizations to compensate for the damages caused by the earthquake, the transactions of purchase, sale, mortgage, registration and cadastre of real estate and declarations and the contracts that must be presented will be exempt from all kinds of taxes, duties, participation fees, fees and charges.
Within the framework of the national and international projects that are carried out in this context, all kinds of prefabricated materials, containers and temporary shelters, construction materials, machinery, motor vehicles, equipment and equipment, spare parts and aid materials to be used in disasters and emergencies. The activities were approved by the Ministry of Commerce and can be imported by the emergency management presidency.
