The constitutional right that the employer grants to the worker who works under the employer with an employment contract is the right to annual vacations if he loses his mental and physical strength due to long working hours and difficult working life conditions, and finally completes his job. for at least one year on the condition of continuing the employment relationship.

In accordance with labor legislation, the annual vacation periods to which workers will be entitled are determined according to the seniority of the workers in one or more workplaces of the same employer. Workers who have completed one (1) year including the probationary period on the date of employment are entitled to enjoy annual vacations.

HOW MANY DAYS ARE THE ANNUAL VACATION PERIOD?

In accordance with article 53 of Labor Law No. 4857, annual vacations must be granted to workers who have worked for at least one year, including the trial period, from the date of incorporation into the workplace.

It is not possible to waive this right due to annual vacations.

Due to their degree, the provisions on annual vacations will not be applied to those who work in seasonal or campaign works lasting less than one year.

The period of paid annual vacations that will be granted to the workers, the seniority in the service;

a) 14 days for those between 1 year and 5 years (including five years),
b) 20 days for those over 5 years old and under 15 years old,
c) It cannot be less than 26 days for those who are 15 years old (inclusive) and over.

The paid annual vacation periods for workers who work in underground works are increased by four days. However, the paid annual vacation period that will be granted to workers aged 18 or under and to workers aged 50 or over may not be less than 20 days. Annual vacation periods can be increased with employment contracts and collective agreements. Periods of work at one or more workplaces of the same employer must be combined.
